General Terms and Conditions for koeppen.app and airdentity.com
1. Provider and scope
1.1 The provider of the services at koeppen.app and airdentity.com is Jan Schenk, Klimatologische Beratung, Ehrenbergstr. 16a, Scanbox #16737, 10245 Berlin, Germany, e-mail hello@koeppen.app, VAT ID DE425119270 (“Köppen”, “we”).
1.2 These Terms apply to all contracts that consumers and businesses (“users”) conclude with us via our websites, in particular for
- the Köppen membership (subscription, clause 4),
- Airdentity naming rights (one-time purchase, clause 5),
- gift vouchers for these services (clause 6).
1.3 Deviating terms of the user do not apply. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (§ 13 BGB).
2. Services
2.1 Köppen provides interactive weather and climate scenes that are rendered exclusively from data (including ERA5/Copernicus, NOAA, DWD). Some of the scenes can be used free of charge, others can be previewed free of charge; unrestricted use of all scenes is reserved for members. Which scenes are free is stated on the respective scene page.
2.2 Airdentity assigns digital naming rights for meteorological pressure systems (high- and low-pressure systems). This is a purely digital product. There is no entitlement to official naming by government weather services or international organisations.
2.3 All content is provided for information and entertainment. It does not replace official warnings or professional advice. For decisions involving a risk to life, limb or property, only the official weather services are authoritative.
3. Conclusion of contract, account, payment
3.1 The presentation of the services on our websites does not constitute a binding offer. The user submits a binding offer by clicking the payment button at the end of the checkout process. The contract is concluded with our confirmation by e-mail or with the provision of the service.
3.2 Checkout is handled by the payment service provider Stripe Payments Europe, Ltd., Dublin, Ireland. Payment data is processed exclusively by Stripe; we do not store any card data.
3.3 A user account is required to access paid services. Sign-in takes place without a password via a sign-in link sent by e-mail. The user keeps their e-mail address up to date and protects access to their mailbox. An account is not transferable.
3.4 Prices: All prices are final prices. Pursuant to § 19 UStG, no VAT is charged or shown. Prices may be displayed in the user’s currency; the amount shown during checkout is authoritative.
3.5 Invoices and payment receipts are provided electronically (e-mail from Stripe, customer portal in the account).
4. Köppen membership (subscription)
4.1 The membership is concluded with either a monthly or an annual term. The price is payable in advance for the respective billing period.
4.2 Renewal: The membership renews automatically for the chosen term unless it is cancelled before the end of the current period.
4.3 Cancellation: The user may cancel at any time, effective at the end of the current billing period, without giving reasons. Cancellation is possible via the “Cancel contracts here” button on koeppen.app (also without signing in), via the customer portal in the account or by e-mail to hello@koeppen.app. Access remains in place until the end of the paid period; amounts already paid are not refunded pro rata.
4.4 We may cancel the membership with four weeks’ notice, effective at the end of the billing period. The right of both parties to extraordinary termination for good cause remains unaffected.
4.5 Price changes apply only to newly concluded memberships. An existing membership continues at the agreed price; if it is to be continued at a new price, we will ask the user for their express consent beforehand.
4.6 Switching between monthly and annual terms is possible via the customer portal; differences in amount are offset pro rata.
4.7 Failed payment: If a renewal payment fails, the payment will be retried and the user informed. If payment is not made, the membership ends at the end of the paid period.
5. Airdentity naming rights
5.1 By purchasing a “National” or “International” naming right, the user acquires the right to assign a first name to a pressure system that forms in the chosen area after the purchase. The name applies for the lifetime of this pressure system. If a system is officially renamed or ceases to exist, the name will be assigned to the next suitable system or the purchase price will be refunded.
5.2 Rules for names: Only first names in Latin letters are permitted. Surnames, company and brand names, abbreviations, invented terms and offensive, discriminatory or infringing designations are not permitted. We may reject impermissible names or remove them after publication; in this case there is no entitlement to a refund.
5.3 User’s responsibility: The user is responsible for the chosen name, in particular for ensuring that no third-party name, trademark, copyright or personality rights are infringed. The user indemnifies us against third-party claims arising from the choice, registration or publication of the name, including reasonable costs of legal defence, to the extent that the user is responsible for the infringement.
5.4 Rights of use and publication: The user grants us the right, unlimited in time and territory and sublicensable, to use and distribute the name in connection with the pressure system, in particular on maps, in rankings, in automatically generated weather videos, via RSS feeds and interfaces, and to the press, broadcasters and digital media worldwide. By default, only the assigned first name is displayed; the buyer’s real name is displayed only with express consent, which may be withdrawn at any time.
5.5 Area and origin: The “National” naming right requires a billing address in the country concerned. Pressure systems are assigned according to where they form. In case of deception about origin, the name may be removed even after publication; the entitlement to the naming right and to a refund lapses.
5.6 No entitlement to timing: There is no entitlement to assignment on a particular day, to a particular type (high or low) or to a particular location of a pressure system. Changes may take up to 24 hours to become visible on websites and in feeds. Tropical cyclones are excluded from naming.
5.7 Extreme weather: If a severe weather event occurs in connection with a named system, this does not give rise to any claim for compensation, renaming or refund. In individual cases we may withdraw names from publication temporarily or permanently out of respect for those affected.
5.8 Certificate: After the assignment, we provide a digital certificate (PDF).
6. Gift vouchers
6.1 Vouchers for the membership or an Airdentity naming right can be purchased and sent by e-mail to a person named by the buyer, on a chosen date if desired.
6.2 A voucher is redeemed during checkout by entering the code; the recipient chooses the name or term themselves and concludes the contract for the service with us. These Terms apply to them accordingly. A gifted membership ends after one year without renewing automatically.
6.3 Vouchers are valid for three years from purchase, cannot be redeemed for cash and can be redeemed only once.
6.4 The right of withdrawal under clause 7 applies to the purchase of a voucher as long as the voucher has not been redeemed.
7. Right of withdrawal for consumers
7.1 Consumers have a statutory right of withdrawal. The withdrawal information with the model withdrawal form is available before the contract is concluded.
7.2 Membership: If the user requests that the membership begin immediately and confirms their awareness of this, they owe, in the event of withdrawal, a reasonable amount for the service provided up to the withdrawal.
7.3 Airdentity naming right: This is digital content produced to customer specifications. Before purchase, the user expressly consents to our beginning the assignment of the name before the withdrawal period expires and confirms their awareness that their right of withdrawal expires upon assignment and publication of the name.
8. Use of scenes, data and copyright
8.1 Members may use scenes for private, non-commercial purposes and share links to them. Commercial use, in particular in teaching, media, presentations or as a service of one’s own, requires our prior consent (request to hello@koeppen.app).
8.2 The data sources are named on the respective scene page and under Data sources. For ERA5/Copernicus, the attribution “Contains modified Copernicus Climate Change Service information” must be retained.
8.3 Design, software and trademarks (Köppen, MeteoProof, Airdentity) are protected. Automated access (scraping, bots) and circumvention of access protection are prohibited.
9. Availability, changes
9.1 We strive for high availability but do not guarantee uninterrupted accessibility. Maintenance and outages of third-party providers (Microsoft Azure, Stripe, data suppliers) may lead to interruptions.
9.2 We may further develop and add to scenes and discontinue individual scenes, as long as the essential character of the membership is preserved. We inform members of significant restrictions by e-mail; in the event of a significant deterioration, they may terminate for cause.
10. Liability
10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act (Produkthaftungsgesetz).
10.2 In cases of simple negligence, we are liable only for breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.
10.3 We accept no liability for the accuracy of the content of weather and climate representations; see clause 2.3.
11. Data protection
Information on the processing of personal data can be found in our privacy policy.
12. Dispute resolution, final provisions
12.1 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12.2 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this applies only insofar as they are not deprived of the protection afforded by mandatory provisions of the law of the country of their habitual residence.
12.3 For businesses, the place of jurisdiction is Berlin.
12.4 Should individual provisions be invalid, the remainder of the contract remains valid.
12.5 The contract language is German. Translations (English, French, Italian, Spanish) are provided for information; in the event of discrepancies, the German version prevails.
